Cymhwyso
2.—(1) Mae'r Gorchymyn hwn yn gymwys o ran unrhyw weithgaredd morol trwyddedadwy a Gweinidogion Cymru yw'r awdurdod trwyddedu priodol ar ei gyfer o dan adran 113(4)(b) o Ddeddf y Môr a Mynediad i'r Arfordir 2009(1) ac mae cyfeiriadau yn y Gorchymyn hwn at “yr awdurdod trwyddedu” i'w darllen yn unol â hynny.
(2) Nid oes dim yn y Gorchymyn hwn yn gymwys o ran unrhyw swyddogaeth sydd wedi ei heithrio o fewn ystyr adran 98(6) o'r Ddeddf honno.

Yn rhinwedd adran 113(4)(b) o Ddeddf y Môr a Mynediad i'r Arfordir 2009, Gweinidogion Cymru yw'r awdurdod trwyddedu priodol mewn cysylltiad ag unrhyw beth a wneir wrth gyflawni gweithgareddau morol trwyddedadwy o ran Cymru a rhanbarth glannau Cymru ac eithrio gweithgareddau pan yr Ysgrifennydd Gwladol yw'r awdurdod trwyddedu priodol ar eu cyfer o dan adran 113(4)(a) a (5) o'r Ddeddf honno. Gweler adran 322(1) i gael y diffiniad o “Welsh inshore region”.
