Mae'r Rheoliadau hyn yn rhagnodi'r cyrsiau cymhwysol a'r personau cymhwysol at ddibenion adran 28 o Deddf Addysg Uwch 2004 (“Deddf 2004”).
Mae adran 27 o Ddeddf 2004 yn galluogi Gweinidogion Cymru i osod amod ar grantiau Cyngor Cyllido Addysg Uwch Cymru (“y Cyngor”), yn ei gwneud yn ofynnol i'r Cyngor osod amod o dan adran 28 o Ddeddf 2004 ar gymorth ariannol a roddir i gyrff llywodraethu sefydliadau perthnasol. Ceir amod o dan adran 28 sy'n ei gwneud yn ofynnol i gorff llywodraethu sefydliad perthnasol i sicrhau nad yw'r ffioedd sy'n daladwy o ran unrhyw gwrs cymhwysol gan berson cymhwysol yn uwch na symiau'r ffi sylfaenol neu uwch sy'n gymwys i'r cwrs hwnnw. Rhagnodir symiau ffi sylfaenol ac uwch gan Reoliadau Ffioedd Myfyrwyr (Symiau) (Cymru) 2011.
Y cyrsiau cymhwysol a ragnodir gan reoliad 3 yw'r cyrsiau hynny a ddynodir o dan adran 22 o Ddeddf Addysgu ac Addysg Uwch 1998 a ddarperir gan sefydliadau a ariennir yn gyhoeddus yng Nghymru pan fo blwyddyn academaidd gyntaf y cwrs yn dechrau ar neu ar ôl 1 Medi 2012. Mae eithriad ar gyfer “cyrsiau penben” os oedd y cwrs gwreiddiol wedi dechrau cyn 1 Medi 2012.
Y personau cymhwysol a ragnodir gan reoliad 4 yw'r personau hynny sydd, ar ddiwrnod cyntaf y flwyddyn academaidd berthnasol, yn dod o fewn i'r Atodlen, ac eithrio'r personau hynny nad oes ganddynt hawl i gymorth o dan Reoliadau Grantiau a Benthyciadau Dysgu y Cynulliad (Addysg Uwch) (Cymru) 2011 (O.S. 2011/148 (Cy.32)) oherwydd paragraffau penodol yn rheoliad 4 o'r Rheoliadau hynny, neu'r personau y mae ganddynt eisoes radd anrhydedd o unrhyw sefydliad yn y DU. Mae eithriad i'r myfyrwyr hynny sy'n trosglwyddo i gwrs cymhwysol o gwrs a ddechreuodd cyn 1 Medi 2012. Mae eithriadau mewn perthynas â gradd anrhydedd flaenorol ar gyfer personau sy'n ymgymryd â chyrsiau ar gyfer hyfforddiant cychwynnol athrawon, sydd wedi ennill y radd anrhydedd yn unig fel rhan o gwrs sengl y maent yn ymgymryd ag ef yn gyfredol neu pan fo'r cwrs yn arwain at gymhwyster fel gweithiwr cymdeithasol, meddyg, deintydd, milfeddyg neu bensaer.
Mae'r asesiad effaith rheoleiddiol sy'n gymwys i'r Rheoliadau hyn ar gael gan Lywodraeth Cynulliad Cymru, Parc Cathays, Caerdydd, CF10 3NQ.
