The Welsh Ministers, in exercise of the powers conferred on them by section 5 of the Children and Families (Wales) Measure 2010(1), make the following Regulations—

Title, application and commencement E+W

1.—(1) The title of these Regulations is The Child Poverty Strategy (Wales) Regulations 2011.

(2) These Regulations come into force on 6 April 2011.

(3) These Regulations apply in relation to Wales.

Interpretation E+W

2.  In these Regulations—

(a) “child poverty strategy” (“strategaeth tlodi plant”) means a strategy as set out in section 2 of the Children and Families (Wales) Measure 2010;

(b) “the Welsh authorities” (“yr awdurdodau Cymreig”) for the purposes of these Regulations does not include the Welsh Ministers [F1 , a local authority or a corporate joint committee established by regulations made under Part 5 of the Local Government and Elections (Wales) Act 2021].

Duration of the first and subsequent child poverty strategies E+W

3.—(1) The first child poverty strategy must relate to the period from 1 April 2012 to 31 March 2014.

(2) Subsequent strategies must relate to the period of three years beginning on 1 April in the year when the previous strategy period expires.

Timing of publication of the first and subsequent child poverty strategy E+W

4.—(1) The first child poverty strategy is to be published on or before 31 March 2012.

(2) Subsequent strategies must be published on or before 1 April in the year in which the strategy period for that strategy commences in accordance with regulation 3(2).

Manner of publication of a child poverty strategy E+W

5.—(1) A Welsh authority must publish a strategy by placing it on its website on the date that a strategy is published.

(2) A Welsh authority must also make the strategy available for inspection by members of the public–

(i) at the authority’s offices; and

(ii) at any other appropriate place.

Review of the child poverty strategy E+W

6.—(1) A review of the first strategy undertaken by a Welsh authority must be completed by 31 March 2014.

(2) All subsequent strategies are to be reviewed every 3 years thereafter.

(3) The Welsh authority must publish the review report by placing it on its website.

Consultation requirements E+W

7.  A Welsh authority, before publishing a strategy, must consult the Welsh Ministers, local authorities and other persons as it considers appropriate.

Explanatory Note

(This note is not part of the Regulations)

These Regulations come into force on 6 April 2011 and apply in Wales.

Section 2 of the Children and Families (Wales) Measure 2010 imposes duties on Welsh authorities to prepare and publish a strategy for contributing to the eradication of child poverty in Wales. In these Regulations the Welsh Ministers and local authorities are excluded from the definition of Welsh authorities.

Regulation 3 provides for the duration of the first and subsequent child poverty strategies.

Regulation 4 provides for the timing of the publication of the child poverty strategies.

Regulation 5 provides for the manner in which a Welsh authority must publish a child poverty strategy.

Regulation 6 provides the dates upon which a review of a child poverty strategy published by a Welsh authority must be completed. Regulation 6 also provides that a Welsh authority must publish a review report and the review report is to be displayed on the website of the Welsh authority.

Regulation 7 provides for the Welsh authority to conduct a consultation prior to the child poverty strategy being published.
