Gweithgareddau mewn perthynas â gwaredu neu adfer gwastraff

5.—(1) Nid yw gweithgaredd gan sefydliad neu ymgymeriad sy'n ymwneud â gwaredu neu adfer gwastraff yn weithgaredd esempt, oni fodlonir yr amodau yn yr erthygl hon.

(2) Amod 1 yw fod y sefydliad neu ymgymeriad yn ymgymryd ag—

(a)gwaredu ei wastraff amheryglus ei hunan yn y man cynhyrchu; neu

(b)adfer gwastraff.

(3) Amod 2 yw fod y math a'r maint o wastraff sydd dan sylw, a'r dull o waredu neu adfer, yn gyson â'r angen i gyrraedd yr amcanion a grybwyllir yn Erthygl 13 o'r Gyfarwyddeb Fframwaith Gwastraff.

(4) Amod 3 yw fod y sefydliad neu ymgymeriad wedi ei gofrestru gyda'r awdurdod trwyddedu.

(5) Rhaid i'r awdurdod trwyddedu at ddibenion paragraff 4, gadw cofrestr sy'n cynnwys enw a chyfeiriad pob sefydliad neu ymgymeriad sy'n ymgymryd â gweithgaredd esempt sy'n cynnwys gwaredu neu adfer gwastraff o fewn ardal yr awdurdod trwyddedu.

(6) Ceir cadw'r gofrestr mewn unrhyw ffurf.

(7) Yn yr erthygl hon—

(a)mae i “sefydliad” ac “ymgymeriad”, yn eu trefn, yr ystyron a roddir i “establishment” ac “undertaking” yn erthyglau 23 a 24 o'r Gyfarwyddeb Fframwaith Gwastraff;

(b)mae i “gwastraff amheryglus” yr ystyr a roddir i “non-hazardous waste” yn y Gyfarwyddeb Fframwaith Gwastraff;

(c)mae i “adfer” yr ystyr a roddir i “recovery” yn Erthygl 3 o'r Gyfarwyddeb Fframwaith Gwastraff.
