Gorfodi

32.—(1) Mewn arolygfa ffin, mae'r Rheoliadau hyn yn cael eu gorfodi gan y canlynol—

(a)mewn perthynas ag anifeiliaid, gan Weinidogion Cymru; a

(b)mewn perthynas â chynhyrchion, gan yr awdurdod lleol.

(2) Y tu allan i arolygfa ffin, mewn perthynas ag anifeiliaid, gorfodir hwy gan yr awdurdod lleol.

(3) Y tu allan i arolygfa ffin, mewn perthynas â chynhyrchion, gorfodir hwy gan y canlynol—

(a)yr awdurdod lleol; neu

(b)yr Asiantaeth Safonau Bwyd mewn unrhyw safle torri, sefydliad sy'n trafod anifeiliaid hela neu ladd-dy, neu fangreoedd lle y mae'r Asiantaeth yn gorfodi Rheoliadau Hylendid Bwyd (Cymru) 2006(1).

(4) Yn ychwanegol, mewn perthynas â chynhyrchion, gorfodir hwy gan swyddog tollau cyffredinol mewn unrhyw fan (ac eithrio cyfleusterau arolygu mewn arolygfa ffin) lle y mae'r nwyddau'n ddarostyngedig i oruchwyliaeth gwasanaeth y tollau gan y swyddog hwnnw o dan Erthyglau 37 a 38 o Reoliad y Cyngor (EEC) Rhif 2913/92 sy'n sefydlu Cod Tollau'r Gymuned.

(5) Caiff Gweinidogion Cymru gyfarwyddo, mewn perthynas ag achosion o ddisgrifiad penodol neu achos penodol, y caniateir i Weinidogion Cymru gyflawni unrhyw ddyletswydd a osodir ar awdurdod lleol o dan y rheoliad hwn.

(6) Rhaid i swyddog awdurdod gorfodi sy'n darganfod cynnyrch, wrth arfer unrhyw swyddogaeth statudol, mewn unrhyw fan sydd o dan oruchwyliaeth gwasanaeth y tollau, a allai fod wedi ei gludo i mewn yn groes i'r Rheoliadau hyn, hysbysu swyddog tollau cyffredinol a chadw'r llwyth neu'r cynnyrch hyd nes y bydd y cyfryw swyddog â gofal drosto.
