(Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)
Mae'r Rheoliadau hyn yn gweithredu Cyfarwyddeb 2004/35/EC Senedd Ewrop a'r Cyngor ar atebolrwydd amgylcheddol parthed atal ac adfer difrod amgylcheddol.
Maent yn gymwys i ddifrod i rywogaethau a warchodir, cynefinoedd naturiol, safleoedd o ddiddordeb gwyddonol arbennig, dŵr a thir (rheoliad 4).
Maent yn cael eu gorfodi gan y cyrff a bennir yn rheoliadau 10 ac 11.
Maent yn darparu, ar gyfer gweithgareddau economaidd penodol, bod rhaid i'r gweithredwr, pan fo risg agos o ddifrod amgylcheddol, gymryd camau i'w atal, ac os yw wedi digwydd, rhaid iddo atal difrod pellach. Pan fo difrod wedi digwydd, rhaid i'r awdurdod gorfodi asesu'r difrod a chanfod mesurau adfer. Rhaid iddo wedyn gyflwyno hysbysiad adfer i'r gweithredwr cyfrifol gan bennu pa waith adfer y mae ei angen (Rhan 3).
Maent yn gwneud darpariaeth ar gyfer gorfodi (Rhan 4).
Mae torri darpariaethau a bennir yn y Rheoliadau yn dramgwydd y gellir ei gosbi—
(a)ar gollfarn ddiannod, â dirwy nad yw'n fwy na'r uchafswm statudol neu garchariad am gyfnod nad yw'n hwy na thri mis, neu'r ddau; neu
(b)ar gollfarn ar dditiad, â dirwy neu garchariad am gyfnod nad yw'n hwy na dwy flynedd, neu'r ddau.
Mae asesiad effaith rheoleiddiol wedi'i baratoi a gellir cael copïau oddi wrth Lywodraeth Cynulliad Cymru, Parc Cathays, Caerdydd CF10 3NQ.
