Cerbydau di-fwg
4.—(1) Yn ddarostyngedig i baragraffau canlynol y rheoliad hwn, rhaid i gerbyd fod yn ddi-fwg os caiff ei ddefnyddio —
(a)i gludo aelodau o'r cyhoedd neu garfan o'r cyhoedd (p'un ai am dâl neu dan log ai peidio); neu
(b)at ddibenion gwaith gan fwy nag un person (hyd yn oed os yw'r personau sy'n ei ddefnyddio at y cyfryw ddibenion yn gwneud hynny ar adegau gwahanol, neu ar adegau ysbeidiol yn unig).
(2) Mae'r rheoliad hwn yn gymwys i gerbydau a rhannau o gerbydau sy'n gaeedig.
(3) Mae cerbyd neu ran o gerbyd yn gaeedig at ddibenion paragraff (2) os oes ganddo ddrysau neu ffenestri y gellir eu hagor ond nid yw'n gaeedig oni bai bod to drosto yn gyfan gwbl neu'n rhannol.
(4) Mae'r rheoliad hwn yn gymwys i bob cerbyd heblaw —
(a)awyrennau; neu
(b)llongau neu hofranlongau y gellid gwneud rheoliadau ar eu cyfer o dan adran 85 o Ddeddf Llongau Masnachol 1995 (p.21) (diogelwch ac iechyd ar longau), gan gynnwys yr adran honno fel y'i cymhwysir gan unrhyw Orchymyn yn y Cyfrin Gyngor o dan adran 1(1)(h) o Ddeddf Hofranlongau 1968 (p.59) neu i bersonau ar unrhyw long neu hofrenlong o'r fath; neu
(c)cerbydau preifat
(5) Yn y rheoliad hwn nid yw “to” yn cynnwys unrhyw do a gaiff ei roi o'r neilltu yn gyfan gwbl fel nad yw dros unrhyw ran o gerbydran y caiff personau deithio ynddi.
