Mae'r Rheoliadau hyn, sy'n gymwys i Gymru ac sy'n dod i rym ar 1 Chwefror 2006, yn rhoi effaith i Erthygl 13d o Gyfarwyddeb y Cyngor 2000/29/EC dyddiedig 8 Mai 2000 (OJ Rhif L 169, 10.7.00, t.1), fel y'i diwygiwyd ddiwethaf gan Gyfarwyddeb y Comisiwn 2005/15/EC dyddiedig 28 Chwefror 2005 (OJ Rhif L 56, 2.3.2005, t. 12), (“y Gyfarwyddeb”), sy'n ei gwneud yn ofynnol i Aelod-wladwriaethau godi ffioedd i gwrdd â'r costau sy'n digwydd oherwydd gwiriadau dogfennol, gwiriadau adnabod a gwiriadau iechyd planhigion ar fewnforion planhigion, cynhyrchion planhigion a phethau eraill penodol o drydydd gwledydd y darperir ar eu cyfer yn erthygl 13a(1) o'r Gyfarwyddeb.

Mae'n ofynnol i fewnforiwr dalu'r ffi a bennir yn Atodlen 1 ar gyfer gwiriadau iechyd planhigion a wneir, ac eithrio os yw ffioedd archwilio gostyngol ar fewnforion yn gymwys (rheoliad 4(2) a (3)). Mae Atodlen 2 yn pennu'r ffioedd gostyngol sy'n gymwys, pa un a wneir archwiliad ai peidio, o ran gwiriadau iechyd planhigion ar flodau penodol sydd wedi cael eu torri ac ar ffrwythau penodol sy'n tarddu o wledydd a bennir yn yr Atodlen honno (rheoliad 4(3)).

Mae'n ofynnol i fewnforiwr dalu'r ffi a bennir yn Atodlen 3 ar gyfer gwiriadau dogfennol a gwiriadau adnabod (rheoliad 4(4)).

Cafodd Arfarniad Rheoliadol ei baratoi ar gyfer y Rheoliadau hyn. Gellir cael copïau oddi wrth Adran yr Amgylchedd, Cynllunio a Chefn Gwlad, Llywodraeth Cynulliad Cymru, Parc Cathays, Caerdydd CF10 3NQ.
