The National Assembly for Wales makes the following Order in exercise of the powers conferred by sections 21(6), 60 and 62 of the Fire and Rescue Services Act 2004(1) and having consulted such persons as it considers appropriate in accordance with section 21(5) of that Act:

Name, coming into force and application

1.—(1) This Order may be cited as the Fire and Rescue Services (National Framework) (Wales) Order 2005 and shall come into force on 17 March 2005.

(2) This Order applies in relation to Wales.

The National Framework

2.  For the purposes of section 21(6) of the Fire and Rescue Services Act 2004, the Fire and Rescue National Framework prepared by the National Assembly for Wales and entitled “The Fire and Rescue National Framework (Wales) 2005” published by the National Assembly for Wales in March 2005 shall have effect.

Explanatory Note

(This note is not part of the Order)

Section 21 of the Fire and Rescue Services Act 2004 requires the National Assembly for Wales to prepare a Fire and Rescue National Framework, which must set out priorities and objectives for fire and rescue authorities and may provide guidance. Fire and rescue authorities must have regard to the Framework in carrying out their functions. Section 21(6) of the Act provides that the Framework only has effect when given effect by the Assembly by order. Article 2 of this Order gives effect to the Fire and Rescue National Framework (Wales) 2005. Copies of the Framework may be obtained from the Social Justice and Regeneration Department, the National Assembly for Wales, Cathays Park, Cardiff. It is also available on the Assembly website: http://www.housing.wales.gov.uk/.
