Seiliau dros apelio yn erbyn tynnu'n ôl, hepgor neu lacio hysbysiad adfer

4.—(1) Cyhyd ag y bodlonir yr amodau a bennir ym mharagraff (2), gellir gwneud apêl o dan adran 71(1)(b) neu (c) o'r Ddeddf yn erbyn tynnu'n ôl hysbysiad adfer, neu hepgor neu lacio ei ofynion, a hynny ar unrhyw un o'r seiliau a bennir ym mharagraff (3).

(2) Dyma'r amodau y cyfeirir atynt ym mharagraff (1)—

(a)nad yw'r awdurdod perthnasol wedi dyroddi hysbysiad adfer arall mewn perthynas â'r un gwrych neu berth uchel; a

(b)na chydsyniodd y person sy'n dymuno apelio â thynnu'n ôl yr hysbysiad adfer neu (yn ôl y digwydd) â hepgor neu lacio gofynion yr hysbysiad hwnnw.

(3) Dyma'r seiliau y cyfeirir atynt ym mharagraff (1) —

(a)na fu unrhyw newid sylweddol mewn amgylchiadau ers gwneud y gŵyn, y dyroddwyd yr hysbysiad adfer mewn cysylltiad â hi, sef newid a fyddai'n cyfiawnhau tynnu'n ôl yr hysbysiad adfer neu (yn ôl y digwydd) hepgor neu lacio ei ofynion;

(b)bod gofynion yr hysbysiad adfer, fel y maent wedi'u hepgor neu wedi'u llacio, yn annigonol i wneud iawn am effaith andwyol y gwrych neu'r berth uchel ar y mwynhad rhesymol a gaiff yr achwynydd o'r eiddo domestig a bennir yn yr hysbysiad adfer neu i atal ailadrodd yr effaith andwyol honno; neu

(c)yn achos apêl gan berchennog neu feddiannydd y tir cyfagos, bod gofynion yr hysbysiad adfer, fel y maent wedi'u hepgor neu wedi'u llacio, yn fwy na'r hyn sy'n angenrheidiol i wneud iawn am effaith andwyol y gwrych neu'r berth uchel ar y mwynhad rhesymol a gaiff yr achwynydd o'r eiddo domestig a bennir yn yr hysbysiad neu i atal ailadrodd yr effaith andwyol honno.
