The Secretary of State, with the consent of the Scottish Ministers and the Welsh Ministers, makes these Regulations in exercise of the powers conferred by Articles 2A, 15(1) and 18(1) of Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast)(1):
1.—(1) These regulations may be cited as the Persistent Organic Pollutants (Amendment) Regulations 2023 and come into force on 4th July 2023.
(2) These regulations extend to England and Wales and Scotland.
2.—(1) Part A of Annex 1 of Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast) (Substances listed in the Convention and in the Protocol as well as substances listed only in the Convention) is amended as follows.
(2) In the entry for perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds, in the 4th column, in point 5(c), for “4 July 2023” substitute “3 December 2025”.

These regulations amend Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast) (OJ No L 169, 25.6.2019, p 45) to extend the period for which the specific exemption in Annex 1 applicable to perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds for certain personal protective equipment applies.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
EUR 2019/1021, amended by EUR 2020/784 and S.I. 2020/1358 and S.I. 2022/1293; there are other amending instruments but none is relevant. Consent of the Welsh Ministers and the Scottish Ministers was obtained as required by article 2A.
