The Secretary of State for Health and Social Care makes the following Regulations in exercise of the powers conferred by sections 1(1) and (2)(e), 2(1) and 3(1) to (3) of, and paragraph 5(a) of Schedule 2 and Schedule 3 to, the Public Service Pensions Act 2013(1) (“the 2013 Act”).

In accordance with section 3(5) of the 2013 Act, these Regulations are made with the consent of the Treasury.

In accordance with section 22(2)(a) of the 2013 Act, the Secretary of State has consulted the representatives of such persons as appear to the Secretary of State likely to be affected by these Regulations, with a view to reaching agreement with them.

In accordance with section 22(2)(b) of the 2013 Act, the Secretary of State has laid a report before Parliament(2) in relation to these Regulations.

Citation, commencement, effect and extent

1.—(1) These Regulations may be cited as the National Health Service Pension Scheme (Member Contributions) (Amendment) Regulations 2023.

(2) These Regulations come into force on 31st May 2023.

(3) These Regulations have effect retrospectively from 1st April 2023.

(4) These Regulations extend to England and Wales.

Amendment of the National Health Service Pension Scheme Regulations 2015

2.—(1) The National Health Service Pension Scheme Regulations 2015(3) are amended as follows.

(2) In regulation 30 (members’ contributions: employees)(4)—

(a)in paragraph (3), for the table (other than the heading) substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Health Service Pension Scheme Regulations 2015 (S.I. 2015/94) (“the 2015 Regulations”).

Regulation 2 amends the 2015 Regulations to update the pensionable earnings bands that determine a member’s contribution rate for the 2023/24 scheme year.

These Regulations come into force on 31st May 2023 and have retrospective effect from 1st April 2023. Section 3(3)(b) of the Public Service Pensions Act 2013 (c. 25) provides that scheme regulations may make retrospective provision.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary of public sector is foreseen.
