The Secretary of State for Education makes the following Order in exercise of the power conferred by section 123(4)(a) of the Education Act 2002(1).
1.—(1) This Order may be cited as the School Teachers’ Incentive Payments (England) (Amendment) Order 2022 and comes into force on 1st September 2022.
(2) This Order extends to England and Wales.
2.—(1) The School Teachers’ Incentive Payments (England) Order 2019(2) is amended as follows.
(2) In article 2(2) (incentive payments to school teachers)—
(a)in sub-paragraph (b) omit “and”; and
(b)after sub-paragraph (c) insert—
“and
(d)the Levelling Up Premium,”.

This Order amends the School Teachers’ Incentive Payments (England) Order 2019 (S.I. 2019/1133). It adds the Levelling Up Premium to the list of schemes payment under which is not to be treated as remuneration for the purposes of section 122(1) of the Education Act 2002 (c. 32).
An impact assessment has not been produced for this instrument as it has no impact on business or civil society organisations. The instrument has minimal impact on the public sector.
