The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).

The Secretary of State is a Minister designated(2) for the purposes of section 2(2) of the European Communities Act 1972 in relation to the environmental aspects of product design.

Citation and commencement

1.  These Regulations may be cited as the Energy Information (Amendment) Regulations 2020 and come into force on 23rd November 2020.

Amendment of the Energy Information Regulations 2011

2.—(1) The table set out in paragraph 1 of Schedule 1 (EU measures) to the Energy Information Regulations 2011(3) is amended as follows.

(2) For the entry relating to household combined washer-driers, substitute—

Household combined washer-dryersCommission Delegated Regulation (EU) 2019/2014 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of household washing machines and household washer-dryers and repealing Commission Delegated Regulation (EU) No 1061/2010 and Commission Directive 96/60/EC(4)Articles 3(1)(a) and (b) and 10 of Commission Delegated Regulation (EU) 2019/2014 apply from 23rd November 2020; all other Articles of that Regulation apply from 1 March 2021.

(3) For the entry relating to household washing machines, in the second row for Columns 2 and 3, substitute—

(4) For the entry relating to household dishwashers, in the second row for Columns 2 and 3, substitute—

(5) For the entry relating to household refrigerators, freezers and their combinations, in the second row for Columns 2 and 3, substitute—

(6) For the entry relating to televisions, substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument amends the Energy Information Regulations 2011 (S.I. 2011/1524) in relation to household combined washer-dryers, household washing machines, household dishwashers, household refrigerating appliances and electronic displays. It substitutes new Commission Delegated Regulations into the list of EU measures in Schedule 1 to the Energy Information Regulations 2011 which allows them to be enforced by the market surveillance authorities.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

Section 2(2) was relevantly amended by section 27(1) of the Legislative and Regulatory Reform Act 2006 (c.  51) and by section 3 of, and Part 1 of the Schedule to, the European Union (Amendment) Act 2008 (c. 7). The European Communities Act 1972 was repealed on exit day by the European Union (Withdrawal) Act 2018 (c. 16), but continues to have effect until IP completion day pursuant to section 1A of that Act, inserted by section 1 of the European Union (Withdrawal Agreement) Act 2020 (c. 1).
