The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018(1).

The requirements of paragraph 3(2) of Schedule 7 to that Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

Citation and commencement

1.  These Regulations may be cited as the Animals (Scientific Procedures) Act 1986 (EU Exit) Regulations 2019 and come into force on exit day.

Amendment of the Animals (Scientific Procedures) Act 1986

2.—(1) The Animals (Scientific Procedures) Act 1986(2) is amended as follows.

(2) In section 2C (licensing of undertakings)(3), in subsection (2), for “the Animals Directive” substitute “this Act”.

(3) In section 20 (functions of the Committee for the Protection of Animals Used for Scientific Purposes)(4)—

(a)omit subsection (4);

(b)in subsection (6), omit the definition of “the foreign committees”.

(4) In section 20B (scientific methods etc which do not use protected animals)(5), in subsection (2)—

(a)omit paragraphs (a) and (b);

(b)in paragraph (c), omit “other”.

(5) In section 21A (statistics and reporting)(6)—

(a)in subsection (1), omit paragraph (c) (and the “and” before it);

(b)omit subsections (3) and (4).

(6) In Schedule 2C (conditions in licences)(7)—

(a)in paragraph 12, omit paragraph (b) (and the “and” before it);

(b)in paragraph 16, omit paragraph (b) (and the “and” before it);

(c)in paragraph 26(1)—

(i)omit “in a Member State”;

(ii)omit “there”;

(iii)omit “of the EU”.

(d)in paragraph 27, omit paragraph (b) (and the “and” before it).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in the exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2) of that Act) arising from the withdrawal of the UK from the European Union.

These Regulations make amendments to legislation in the field of scientific procedures carried out on animals in the UK and amend the legislation relating to the licensing of such activity and the inspection of premises in the Animals (Scientific Procedures) Act 1986.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
