The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).

The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to energy and energy sources(2).

Citation and commencement

1.—(1) These Regulations may be cited as the Ecodesign for Energy-Related Products and Energy Information (Amendment) Regulations 2019.

(2) This regulation and regulation 3 come into force on the 21st day after the day on which these Regulations are laid before Parliament.

(3) Regulation 2 comes into force on 1st March 2020.

Amendment of the Ecodesign for Energy-Related Products Regulations 2010

2.  In paragraph 4 of Schedule 1 to the Ecodesign for Energy-Related Products Regulations 2010(3) (declaration of conformity)—

(a)in the first column of entry 18 in the table, omit “or a computer server”;

(b)at the end of the table insert—

30A server or an online data storage productCommission Regulation (EU) 2019/424 of 15 March 2019 laying down ecodesign requirements for servers and data storage products pursuant to Directive 2009/125/EC of the European Parliament and of the Council and amending Commission Regulation (EU) No 617/2013(4).

Amendment of the Energy Information Regulations 2011

3.  In the table in Schedule 1 to the Energy Information Regulations 2011(5) (EU measures), omit the entry for vacuum cleaners.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument amends regulations made under section 2(2) of the European Communities Act 1972 in relation to ecodesign and energy labelling. Regulation 2 amends the Ecodesign for Energy-Related Products Regulations 2010 (S.I. 2010/2617) to add a Commission Regulation on servers and data storage (Regulation 2019/424) to the list of implementing measures that must be included in a declaration of conformity, and make a related consequential amendment. Regulation 3 makes an amendment to the Energy Information Regulations 2011 (S.I. 2011/1524) consequential on the annulment(6) of Commission Delegated Regulation (EU) No 665/2013 on the energy labelling of vacuum cleaners.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
