The Secretary of State, in exercise of the powers conferred by sections 74A and 104(1) of the New Roads and Street Works Act 1991(1), makes the following Regulations.

Citation, commencement and application

1.—(1) These Regulations may be cited as the Street Works (Charges for Occupation of the Highway) (England) (Amendment) Regulations 2018.

(2) They come into force on 28th April 2018.

(3) They apply to England only.

Amendment

2.—(1) The Street Works (Charges for Occupation of the Highway) (England) Regulations 2012(2) are amended as follows.

(2) In regulation 1 (Citation, commencement, expiry and application), omit paragraph (3).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Street Works (Charges for Occupation of the Highway) (England) Regulations 2012 (“the 2012 Regulations”).

Regulation 2 revokes regulation 1(3) of the 2012 Regulations, which provided that they would expire on 13th March 2019. Accordingly the 2012 Regulations will remain in force until amended or revoked.

A full impact assessment has not been produced for this instrument as it maintains the status quo and no, or no significant, impact on the private, voluntary or public sectors is foreseen.

An Explanatory Memorandum has been prepared for these Regulations and is available alongside this instrument at www.legislation.gov.uk.
