Coming into force in accordance with regulation 1

The requirements of paragraph 3(2) of Schedule 7 to the European Union (Withdrawal) Act 2018(1) (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018.

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the European Network of Employment Services (EU Exit) Regulations 2018, and come into force on exit day.

(2) In these Regulations, “Regulation (EC) No 1296/2013” means Regulation (EC) No 1296/2013 of the European Parliament and of the Council, of 11 December 2013 on a European Union Programme for Employment and Social Innovation (“EaSI”) and amending Decision No 283/2010/EU establishing a European Progress Microfinance Facility for employment and social inclusion.

Revocation of retained EU instruments

2.  The instruments specified in the Schedule, which relate to the European Network of Employment Services, are revoked.

Transitional and consequential provisions on the revocation of retained EU instruments

3.—(1) This Regulation applies where—

(a)under Regulation (EU) No 1296/2013, a person has in place a valid grant agreement from the Employment and Social Innovation (“EaSI”) fund immediately before exit day, and

(b)the European Commission has declined to make further payments to that person on or after exit day.

(2) Where this Regulation applies, the Secretary of State may give, or make arrangements for the giving of financial assistance to a person who falls within paragraph (1) under such conditions as the Secretary of State considers appropriate.

Regulation 2

SCHEDULEINSTRUMENTS REVOKED

The instruments revoked are—

(a)Regulation (EU) No 589/2016 of the European Parliament and of the Council of 13 April 2016 on a European Network of employment services (EURES), workers’ access to mobility services and the further integration of labour markets, and amending Regulations (EU) No 492/2011 and EU No 1296/2013;

(b)Regulation (EU) No 1296/2013 of the European Parliament and of the Council, of 11 December 2013 on a European Union Programme for Employment and Social Innovation (“EaSI”) and amending Decision No 283/2010/EU establishing a European Progress Microfinance Facility for employment and social inclusion;

(c)Commission Implementing Decision of 26 November 2012 implementing Regulation (EU) No 492/2011 of the European Parliament and of the Council as regards the clearance of vacancies and applications for employment and the re-establishment of EURES;

(d)Commission Implementing Decision (EU) 2017/1257 of 11 July 2017 on the technical standards and formats required for a uniform system to enable matching of job vacancies with job applications and CVs on the EURES portal;

(e)Commission Implementing Decision (EU) 2017/1255 of 11 July 2017 on a template for the description of national systems and procedures to admit organisations to become EURES Members and Partners;

(f)Commission Implementing Decision (EU) 2017/1256 of 11 July 2017 on templates and procedures for the exchange of information on the EURES network national work programmes at Union level;

(g)Commission Implementing Decision (EU) 2018/170 of 2 February 2018 on uniform detailed specifications for data collection and analysis to monitor and evaluate the functioning of the EURES network;

(h)Decision (EC) No 283/2010/EU of the European Parliament and of the Council, of 25 March 2010 establishing a European Progress Microfinance Facility for employment and social inclusion.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers in section 8(2)(a) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union.

Article 2 of, and the Schedule to, these Regulations revoke eight EU Instruments relating to the European Network of Employment Services (EURES).

Articles 3 saves Regulation (EC) No 1296/2013 of the European Parliament and of the Council, of 11 December 2013 on a European Union Programme for Employment and Social Innovation (“EaSI”) and amending Decision No 283/2010/EU establishing a European Progress Microfinance Facility for employment and social inclusion for the purposes of providing grants to existing grantees should the European Commission refuse to provide this post exit day.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sections is foreseen.
