This Order, is made in exercise of the powers conferred by paragraphs 8(1) of Schedule 8 and 3(1) of Schedule 10 to the Traffic Management Act 2004 (1).

Wokingham Borough Council has applied to the Secretary of State for an order to be made under these powers in respect of part of that Council’s area.

The Secretary of State has consulted the Chief Constable of the Thames Valley Police in accordance with the requirements of paragraphs 8(3) of Schedule 8 and 3(4) of Schedule 10 to the 2004 Act.

Accordingly, the Secretary of State (2) makes this Order.

Citation and commencement

1.  This Order may be cited as the Civil Enforcement of Parking Contraventions (Wokingham Borough Council) Designation Order 2017 and comes into force on 9th October 2017.

Designation of civil enforcement area and special enforcement area

2.  The Secretary of State designates the area described in the Schedule as—

(a)a civil enforcement area for parking contraventions; and

(b)a special enforcement area.

Article 2

SCHEDULEArea designated as a civil enforcement area for parking contraventions and as a special enforcement area

The whole area of Wokingham Borough Council with the exception of—

(a)the M4 Motorway from the boundary with West Berkshire Council at Ordnance Survey national grid reference point SU6967369464 eastwards to the boundary with the Royal Borough of Windsor and Maidenhead at Ordnance Survey national grid reference point SU8206772614 and the slip roads at junction 10 of the M4;

(b)the A329(M) Motorway, from its northern terminus within Wokingham Borough Council’s administrative area south-eastwards for its whole length and including a short stretch of the A329 to the boundary with Bracknell Forest Borough Council at Ordnance Survey national grid reference point SU8407468536;

(c)the A3290 throughout its entire length, including the slip roads at its junction with the A4; and

(d)the A33 from the boundary with Reading Borough Council at Ordnance Survey national grid point SU7147268412 southwards to the boundary with Hart District Council at Ordnance Survey national grid reference point SU7178962865.

(This note is not part of the Order)

This Order designates part of the area of Wokingham Borough Council as a civil enforcement area for parking contraventions and as a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004.

An impact assessment has not been produced as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum is available alongside the instrument on the UK legislation website, www.legislation.gov.uk.

The Secretary of State is the “appropriate national authority” as regards England for the purposes of Part 6 of the Traffic Management Act 2004, by virtue of section 92 of that Act.
