The Wales Act 2017 (Commencement No. 2) Regulations 2017

The Secretary of State, in exercise of the powers conferred by section 71(4) and (6) of the Wales Act 2017(1), makes the following Regulations:

Citation

1.  These Regulations may be cited as the Wales Act 2017 (Commencement No. 2) Regulations 2017.

Commencement of provisions of the Wales Act 2017

2.—(1) The provisions of the Wales Act 2017 listed in paragraph (2) come into force on the day which is four months after the day on which these Regulations are made.

(2) The provisions to which paragraph (1) applies are—

(a)section 21 (transfer of Ministerial functions); and

(b)section 49 (modification of water-related functions).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are the second commencement Regulations made under the Wales Act 2017 (c. 4) (“the Act”).

Regulation 2 brings into force section 21 of the Act relating to the transfer of Ministerial functions, in particular those provisions which allow for functions to be exercised concurrently or jointly with a Minister of the Crown or with the agreement of, or after consultation with, a Minister of the Crown.

Regulation 2 also brings into force section 49 of the Act relating to water, which makes provision allowing for modification of a previously conferred or transferred water-related function; and those providing for such functions to be exercisable concurrently or jointly with a Minister of the Crown or the Welsh Ministers, or only with the agreement of, or after consultation with, a Minister of the Crown or the Welsh Ministers.

These provisions come into force four months after the day on which these Regulations are made.

The following provisions of the Wales Act 2017 (c. 4) will be brought into force by commencement regulations made before the date these Regulations were made.
