The Merchant Shipping (Marine Equipment) Regulations 2016

The Secretary of State, with the consent of the Treasury, makes the following Regulations in exercise of the powers conferred by—

(a)

section 2(2) of the European Communities Act 1972 M1;

(b)

sections 85(1), (3), (5) to (7), 86(1) and 302 of the Merchant Shipping Act 1995 M2; and

(c)

article 3 of the Merchant Shipping (Prevention of Oil Pollution) Order 1983 M3.

The Secretary of State is a Minister designated for the purposes of the European Communities Act 1972 in relation to measures relating to maritime transport M4 and measures relating to the safety of ships and the health and safety of persons on them M5.

In accordance with section 86(4) of the Merchant Shipping Act 1995 the Secretary of State has consulted the persons referred to in that section.

M3S.I. 1983/1106 as amended by S.I. 1985/2002, 1991/2885 and 1993/1580. The provisions that can be made under the Order were extended by section 128 of the Merchant Shipping Act 1995 (c.21) and varied by section 7(6) and (7) of the Merchant Shipping and Maritime Security Act 1997 (c.28).
