Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1), and now vested in the Secretary of State (2):

1.  This Instrument may be cited as “The Walsall Metropolitan Borough Council (York’s Bridge Replacement Scheme) Bridge Scheme 2014 Confirmation Instrument 2014” and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2.  The Walsall Metropolitan Borough Council (York’s Bridge Replacement Scheme) Bridge Scheme 2014 Confirmation Instrument 2014 (“the Scheme”) is hereby confirmed with modifications.

3.  The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA, and at the offices of the Council of Walsall Metropolitan Borough Council, The Civic Centre, Darwell Street, Walsall, WS1 1TP.

THE SCHEDULEHE WALSALL METROPOLITAN BOROUGH COUNCIL (YORK’S BRIDGE REPLACEMENT SCHEME) BRIDGE SCHEME 2014

Walsall Metropolitan Borough Council (hereinafter referred to as “the Council”) make this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:-

1.  The Council are authorised to construct over the navigable waters of the Wyrley and Essington Canal (“the Canal”) the bridge specified in the Schedule to this Scheme as part of the new highway which they are proposing to construct as part of the realignment and improvement of the B4154, Norton Road between Moat Farm Way and a point approximately 300m north of the canal in the area of Pelsall in the Borough of Walsall in the said County of the West Midlands.

2.  This Scheme may be cited as the Walsall Metropolitan Borough Council (York’s Bridge Replacement Scheme) Bridge Scheme 2014.

Given under the seal of the Council on the 7th day of February 2014.

THE SCHEDULE TO THE SCHEMEPLANS AND SPECIFICATIONS OF THE WALSALL METROPOLITAN BOROUGH COUNCIL (YORK’S BRIDGE REPLACEMENT SCHEME) BRIDGE SCHEME 2014

The location and general design of the Bridge are shown on the plans numbered MP/YB/BRO/01, MP/YB/BRO/02 and MP/YB/BRO/03 and marked “The Walsall Metropolitan Borough Council (York’s Bridge Replacement Scheme) Bridge Scheme 2014” sealed with the common seal of the Council and deposited at all reasonable hours at Walsall Metropolitan Borough Council, The Civic Centre, Darwell Street, Walsall, WS1 1TP and at the offices of the Secretary of State.

POINTS OF COMMENCEMENT AND TERMINATION

Bridge

The bridge will commence immediately to the rear of the towpath on the south of the canal and terminate 20.9m away on the north side of the canal.

Highway Realignment

Commencing from a point approximately 190m south of the southern edge of the canal at the junction of the B4154 Norton Road and Moat Farm Way.

Terminating at a point approximately 300m north of the southern edge of the canal.

SPANS

A single structure with an overall span of 20.9 metres

HEADWAY

The headway shall not be less than 2 metres above the towing path and not be less than 3.1 metres above the canal water level. This headway being determined by a weir level of 143.955 metres above Ordnance Datum.

WATERWAY

A minimum clear navigable waterway of 6.4 metres widening to 15.1 metres

OVERALL DIMENSIONS

The overall Bridge width will be 12.63 metres .The Bridge will carry a 7.3 metre wide single carriageway. A 2 metres wide footway will be provided to the west side. On the east side, there will be a hard strip of width 2 metres. Details can be seen on drawing MP/YB/BRO/03.

EXPLANATORY NOTE

(This note is not part of the Order)

This instrument confirms a scheme to construct over the navigable waters of the Wyrley and Essington Canal the bridge specified in the Schedule to this Scheme as part of the new highway which they are proposing to construct as part of the realignment and improvement of the B4154, Norton Road between Moat Farm Way and a point approximately 300m north of the canal in the area of Pelsall in the Borough of Walsall in the said County of the West Midlands.

The Secretary of State has modified this scheme as follows:

(1) In the title of the Scheme WALSALL METROPOLITAN BOROUGH COUNCIL (hereinafter referred to as “the Council”) make this Order in exercise of their powers under section 106 (3) of the Highways Act 1980 and of all other powers enabling them in that behalf:- has been amended to WALSALL METROPOLITAN BOROUGH COUNCIL (hereinafter referred to as “the Council”) make this Scheme in exercise of their powers under section 106 (3) of the Highways Act 1980 and of all other powers enabling them in that behalf.

(2) The title THE SCHEDULE TO THE ORDER has been amended to THE SCHEDULE TO THE SCHEME.

(3) Five additional measurements have been included on drawing MP/YB/BRO/03 and annotated as modifications to the map.

(4) One additional measurement has been included on drawing MP/YB/BRO/01 and annotated as a modification to the map.
