Monitor, being satisfied that it is not reasonable in the circumstances for the trust special administrators of Mid Staffordshire NHS Foundation Trust to carry out the duty of providing Monitor with a final report within the specified statutory period, in exercise of the power conferred by section 65J(2) and (5) of the National Health Service Act 2006(1), makes the following Order:
2006 c.41. Section 65J(2) was inserted by section 16 of the Health Act 2009 (c.21). Section 65J(5) was inserted by section 176 of the Health and Social Care Act 2012 (c.7) and provides that the power in section 65J(2) is to be exercised by Monitor in the case of NHS foundation trusts. See section 275(1) of the National Health Service Act 2006 as amended by paragraph 11 of Schedule 13 to the Health and Social Care Act 2012 for the definition of “the regulator”.
