The Secretary of State makes these Regulations under the powers conferred by section 2(2) of, and by paragraph 1A of Schedule 2 to the European Communities Act 1972(1) (“the Act”). The Secretary of State is a Minister designated(2) for the purposes of the Act in relation to measures relating to the assessment, management and control of environmental noise.
These Regulations and the Regulations they amend, the Environmental Noise (England) Regulations 2006(3), make provision for a purpose mentioned in section 2(2) of the Act. They make references to Directive 2002/49/EC of the European Parliament and of the Council of 25 June 2002 relating to the assessment and management of environmental noise(4). It appears to the Secretary of State that it is expedient for references in those Regulations to certain provisions in the Directive to be construed as references to those provisions as amended from time to time.
