The Secretary of State, in exercise of the powers conferred by paragraph 1 of Schedule 2 to the Police Act 1996 (1), makes the following Regulations.
In accordance with paragraph 6 of Schedule 2 to that Act the Secretary of State has consulted with the Association of Police Authorities, persons whom she considered to represent the interests of county and district councils in England and county and county borough councils in Wales, and such other persons as she thought fit.
1. These Regulations may be cited as the Police Authority (Amendment No. 3) Regulations 2010 and shall come into force on 19th January 2011.
2. The Police Authority Regulations 2008(2) are amended as follows.
3. In regulation 19 (tenure of office), before the words “A person” insert “Subject to regulation 19A,”.
4. After regulation 19 insert—
19A.—(1) This regulation applies to a member referred to in regulation 6(1)(b) or 6(2)(b) whose term of office under regulation 19 would (but for this regulation) expire on or after 19th January 2011 but before 10th May 2012.
(2) The term of office of a member to whom this regulation applies shall, subject to regulations 14 to 17 (disqualification), 21 (resignation) and 24 (removal), be extended until 10th May 2012.
(3) But no term shall be extended under paragraph (2) if, on 19th January 2011, a person other than the member mentioned in paragraph (1) has already agreed to be appointed to the vacancy resulting from the expiry of the term of office mentioned in that paragraph.”

These Regulations amend the Police Authority Regulations 2008 (S.I. 2008/630) to provide for the automatic extension of the terms of office of independent members of police authorities pending the expected abolition of police authorities by the Police Reform and Social Responsibility Bill in May 2012. The term of office of any independent member whose term of office is due to expire before 10th May 2012 is extended until that date subject to provisions on disqualification, resignation and removal. However there is no such extension of a term of office if on the date these Regulations come into force the police authority has already completed arrangements to appoint another person to that office.
