The Secretary of State for Health makes the following Order in exercise of the powers conferred by section 167(1)(b) and (3) of the Health and Social Care Act 2008(1).

Citation, commencement, extent and application

1.—(1) This Order may be cited as the Health and Social Care Act 2008 (Consequential Amendments) (Wales) Order 2010 and will come into force on 26th July 2010.

(2) Subject to paragraph (3), this Order extends to England and Wales.

(3) Paragraph 4 of the Schedule, together with article 3 in so far as it relates to that paragraph, extends to England and Wales, Scotland and Northern Ireland.

(4) This Order applies in relation to Wales only.

Revocation in relation to public health protection

2.  Regulations 12 and 13 of the Canal Boats Regulations 1878(2) are revoked.

Consequential amendments in relation to public health protection

3.  The consequential amendments to enactments set out in the Schedule have effect.

SCHEDULEConsequential amendments in relation to public health protection

Public Health (Aircraft) Regulations 1979

1.  In the Public Health (Aircraft) Regulations 1979(3), in regulation 2(1) (interpretation), omit the definition of “local authority”.

Public Health (Ships) Regulations 1979

2.  In the Public Health (Ships) Regulations 1979(4), in regulation 2(1) (interpretation), in sub-paragraph (b) of the definition of “local authority”—

(a)at the end of paragraph (iii), omit “or”; and

(b)for paragraph (iv), substitute the following paragraphs—

(iv)the Common Council of the City of London,

(v)the Sub-Treasurer of the Inner Temple and the Under Treasurer of the Middle Temple, or

(vi)the Council of the Isles of Scilly;.

Public Health (International Trains) Regulations 1994

3.  In the Public Health (International Trains) Regulations 1994(5), in regulation 2(1) (interpretation), omit the definition of “viral haemorrhagic fever”.

Immigration (European Economic Area) Regulations 2006

4.  In the Immigration (European Economic Area) Regulations 2006(6), in regulation 21(7) (decisions taken on public policy, public security and public health grounds), in sub-paragraph (a), for “to which section 38 of the Public Health (Control of Disease) Act 1984 applies (detention in hospital of a person with a notifiable disease)” substitute “listed in Schedule 1 to the Health Protection (Notification) Regulations 2010(7)”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes consequential amendments to secondary legislation as a result of certain provisions of the Health and Social Care Act 2008, which amend the Public Health (Control of Disease) Act 1984(8), being brought into force in Wales. The Order applies in relation to Wales only.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
