The Secretary of State for Transport makes these Regulations in exercise of the powers conferred by sections 89(3)(1), (4)(2) and (5)(3), 91(b)(4), 97(1)(5), 99(7ZA)(6) and 105(1), (2)(a), (e) and (ea)(7), (3) and (4)(8) of the Road Traffic Act 1988(9) and, in the case of regulations 9, 13(e) and (f), 28 and 29, with the approval of the Treasury in accordance with section 105(4) of the 1988 Act.

The Secretary of State for Transport has consulted with representative organisations in accordance with section 195(2) of the 1988 Act.

The Secretary of State for Transport, in exercising the powers conferred by section 89(4)(b) of the 1988 Act, has taken into account the functions and matters specified in respect of that section in the Department of Transport (Fees) Order 1988(10) and, in exercising the powers conferred by sections 97(1)(a), 99(7ZA) and 105(2)(e) has taken into account the functions and matters specified in respect of those sections in the Department for Transport (Driver Licensing and Vehicle Registration Fees) Order 2003(11).
