The Council of the Royal College of Veterinary Surgeons, in exercise of the powers in section 11 of the Veterinary Surgeons Act 1966(1), has made the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2008 (“the Regulations”) set out in the Schedule to this Order.

Under section 25(1) of that Act, the Regulations do not have effect unless approved by order of the Privy Council.

In exercise of that power their Lordships, having considered the Regulations, make this Order.

Title and commencement

1.    This Order may be cited as the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations Order of Council 2008 and comes into force on 1st April 2009.

2.    The Regulations set out in the Schedule are approved.

Article 2

SCHEDULETHE VETERINARY SURGEONS AND VETERINARY PRACTITIONERS (REGISTRATION) (AMENDMENT) REGULATIONS 2008

The Council of the Royal College of Veterinary Surgeons, in exercise of its powers under section 11 of the Veterinary Surgeons Act 1966(2), makes the following Regulations.

1.  These Regulations may be cited as the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2008.

2.  The Schedule (Table of Fees Payable) to the Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005(3) is replaced by the following—

2.Retention on the register or supplementary veterinary register (regulations 15, 16, 17, 18 and 23)
i.for a veterinary surgeon practising in the United Kingdom;294
ii.for a veterinary surgeon practising outside the United Kingdom;147
iii.for any other veterinary surgeon who has provided the registrar with a declaration in accordance with regulation 23;48
iv.for a veterinary surgeon who is undertaking in the United Kingdom a full-time post-graduate degree course in a veterinary or allied subject and who is required as part of the course to undertake acts of veterinary surgery;147
v.for any other veterinary surgeon who has provided the registrar with a declaration in accordance with regulation 23 and is over the age of 70 on 1st April in the year in which a fee would otherwise be due;0
vi.for a veterinary practitioner registered in the supplementary veterinary register under section 8(1)(a) and (b) of the Act;27
vii.for a veterinary practitioner registered in the supplementary veterinary register under section 8(1)(c) of the Act.13
3.Restoration to the register under regulation 13(1) following removal under section 11(2) of the Act (failure to pay the fee) —
i.veterinary surgeon;294
ii.veterinary practitioner.15
4.Restoration to the register under regulation 13(2) and (3) following removal under section 13(2) or 16(2) of the Act (on request or following a direction of the disciplinary committee)—
i.veterinary surgeon;147
ii.veterinary practitioner.15
5.Temporary registration (regulation 20)—
i.for a veterinary surgeon undergoing a course of study of six months’ duration or less, arranged by a veterinary practice or a group of such practices, for the purpose of improving clinical skills, and where the veterinary surgeon concerned is a national of a developing country which is included in a list approved by the Council;147
ii.in all other cases.294..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order approves the Veterinary Surgeons and Veterinary Practitioners (Registration) (Amendment) Regulations 2008 (“the Regulations”) made on 5 June 2008 by the Council of the Royal College of Veterinary Surgeons (“the RCVS”) under section 11 of the Veterinary Surgeons Act 1966 (c. 36). The Regulations replace the Schedule to the Veterinary Surgeons and Veterinary Practitioners (Registration) Regulations 2005 with a new Schedule (Table of fees payable).

The Regulations provide for an increase in fees payable for annual registration and retention of names on the registers of the RCVS as set out in the Schedule. The increase in fees for all categories of membership is no greater than 3%. The retention fee for a person registered in the supplementary register under section 8 of the Veterinary Surgeons Act 1966, the fee for the restoration of a name to the supplementary register and the fee for restoration to the register under regulation 13(2) for a veterinary practitioner are not increased. No fee is charged for non-practising veterinary surgeons over 70 years of age on 1st April of the year in which a fee would otherwise be due.

The new fees represent the amounts deemed necessary by the Council of the RCVS for the effective administration of the RCVS.

A full impact assessment has not been produced for this Order as a minimal impact on the private or voluntary sectors is foreseen.
