The Secretary of State, in exercise of the powers conferred by section 3, 4, 5 and 7 of the Export Control Act 2002(1), makes the following Order:

1.  This Order may be cited as the Export Control (Democratic Republic of Congo) (Amendment) (No. 2) Order 2008 and shall come into force on 24th July 2008.

2.  The Export Control (Democratic Republic of Congo) Order 2005(2) is amended as follows.

3.  In article 1(2), in the definition of “the Regulation” after the words “26 November 2007” insert “and Council Regulation (EC) No 666/2008 of 15 July 2008(3)”.

4.  In Article 3, for the words “any person, entity or body in, or for use in, the Democratic Republic of Congo” substitute the words “any non-governmental person, entity or body operating in the territory of the Democratic Republic of Congo” where they appear in paragraph (a) and (b).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order implements in part Council Regulation (EC) 666/2008 which amends Council Regulation (EC) 889/2005(4).

Council Regulation (EC) 666/2008 was adopted pursuant to Council Common Position 2008/369/CFSP(5) integrating the measures contained in UN Security Council Resolution 1807 (2008).

Council Regulation (EC) 666/2008 modifies the scope of the restrictive measures on the Democratic Republic of Congo (DRC) by limiting these restrictions to non-governmental persons or entities operating in the territory of the DRC.

A full regulatory impact assessment has not been produced for this instrument, as it has no impact on the costs of business.
