The Secretary of State, acting as the appropriate Minister, makes the following Order in exercise of the powers conferred by section 11 of the Channel Tunnel Act 1987(1).
1. This Order may be cited as the Channel Tunnel (Miscellaneous Provisions) (Amendment) Order 2007 and shall come into force on 14th November 2007.
2.—(1) The Channel Tunnel (Miscellaneous Provisions) Order 1994(2) is amended as follows.
(2) In article 3 (application of tripartite articles)(3) at the beginning of paragraphs (2) and (3) insert “Subject to paragraph (4),” and after paragraph (3) insert—
“(4) Nothing in this article implies the existence of a control zone in the station of London-Waterloo on British Territory.”.
(3) In article 4 (application of enactments) after paragraph (1) insert—
“(1A) The Race Relations Act 1976(4) shall apply to the carrying out by immigration officers of their functions in a control zone outside the United Kingdom as it applies to the carrying out of their functions within the United Kingdom.”
(4) Article 7 (enactments modified)(5) becomes paragraph (1) of article 7 and at the end insert—
“(2) Nothing in paragraph (1)(b) implies the existence of a control zone in the station of London-Waterloo on British Territory.”.
(5) In Schedule 1 (expressions defined)(6) at the end of the definition of “control zone” insert “but excluding the station of London-Waterloo on British territory”.

This Order amends the Channel Tunnel (Miscellaneous Provisions) Order 1994 to provide that there will be no control zone at the station of London-Waterloo in respect of trains travelling between Belgium and the United Kingdom and to prevent continuing international provision in respect of controls exercised at that station having the force of law in the United Kingdom from 14th November 2007, from which date controls will instead be carried out at London-St Pancras. Article 2(3) of this Order applies the Race Relations Act 1976 to the carrying out of functions by immigration officers in a control zone outside the UK.
1987 c. 53. The appropriate Minister is defined in section 13 of that Act.
