1.—(1) This Order may be cited as the Surrey and Sussex Healthcare National Health Service Trust (Transfer of Trust Property) Order 2007 and shall come into force on 1st November 2007.
(2) In this Order—
“the old Trust” means the Surrey and Sussex Healthcare National Health Service Trust; and
“the trust property” means the property specified in the two schedules of trust property more specifically described in paragraphs (1) and (2) of article 2.
2.—(1) On the date that this Order comes into force the property specified in the schedule of trust property prepared and agreed by the old Trust and the Surrey Primary Care Trust(3) and signed on behalf of the old Trust on 18th June 2007 and on behalf of the Surrey Primary Care Trust on 27th June 2007, and any rights and liabilities arising from that property, shall be transferred from the old Trust to the Surrey Primary Care Trust.
(2) On the date that this Order comes into force the property specified in the schedule of trust property prepared and agreed by the old Trust and the Worthing and Southlands Hospitals National Health Service Trust(4) and signed on behalf of the old Trust on 18th June 2007 and on behalf of the Worthing and Southlands Hospitals National Health Service Trust on 27th June 2007, and any rights and liabilities arising from that property, shall be transferred from the old Trust to the Worthing and Southlands Hospitals National Health Service Trust.
3. In any instrument relating to any of the trust property, any reference in relation to that property to the trustees of that property or to the old Trust, shall be construed as a reference to—
(a)in so far as the reference relates to property referred to in article 2(1), the Surrey Primary Care Trust; and
(b)in so far as the reference relates to property referred to in article 2(2), the Worthing and Southlands Hospitals National Health Service Trust.
