The temporary governing body of Haringey Sixth Form Centre(1) (“the School”) being treated as the governing body(2), a qualifying body for the purposes of Chapter 1 of Part 1 of the Education Act 2002(3) (“the Act”), have, in accordance with section 4(2) of the Act, consulted such persons as appear to them to be appropriate.
It is the opinion of the Secretary of State—
(a)pursuant to section 1(1)(a) of the Act, having regard to the matters set out in section 1(2), that the implementation by the governing body of the School of the provisions of this Order may contribute to the raising of educational standards in England, and
(b)pursuant to section 2(5) of the Act, that this Order is not likely to have a detrimental effect on the education of children with special educational needs.
In exercise of the powers conferred upon the Secretary of State by section 2(1) of the Act(4), the Secretary of State for Children, Schools and Families, on the application of the temporary governing body of the School, makes the following Order:

By virtue of section 34(7) of the Act, from the period beginning with the school opening date the temporary governing body is treated as if it were the permanent governing body of the school for the purposes of the Education Acts.
2002 c. 32. Chapter 1 of Part 1 has been amended by Schedule 16 to the Education and Inspections Act 2006 (c. 40).
Sections 2(7) and (8) of the Act (time limit for making orders under this section) were repealed by Schedule 16 to the Education and Inspections Act 2006 (c. 40).
