The Secretary of State for Communities and Local Government makes the following Order in exercise of the powers conferred by sections 409(1) and (6) and 413(1) and (2) of the Greater London Authority Act 1999(1).

In accordance with section 413(3) of that Act she has consulted all bodies which, and all persons who, she considers may be affected.

Citation and commencement

1.  This Order may be cited as the Urban Regeneration Agency (London Development Agency) Transfer Scheme 2000 (Modification) Order 2007, and shall come into force on 18th July 2007.

Modification of Transfer Scheme

2.  The Urban Regeneration Agency (London Development Agency) Transfer Scheme 2000 shall be deemed for all purposes to have come into force with the following inserted after clause 3—

3A.   PROVISIONS IN CONNECTION WITH THE TRANSFER OF DEVELOPMENT AND OPERATIONAL PROPERTY

3A.1.   The rights and liabilities in freehold, leasehold and other property transferred under clause 2.1.2 of this Scheme shall be deemed for the purposes of Schedule 6 to the Regional Development Agencies Act 1998(2) (Vesting and Acquisition of Land: Supplementary Provisions) to have been vested in the Transferee under that Act..

EXPLANATORY NOTE

(This note is not part of the Order)

The Urban Regeneration Agency (London Development Agency) Transfer Scheme 2000, among other matters, transferred to the London Development Agency certain land belonging to the Urban Regeneration Agency. This Order modifies the Scheme by providing that the transferred land shall be deemed to have been vested in the London Development Agency under the Regional Development Agencies Act 1998. The effect of the modification is that the authority conferred by Schedule 6 to that Act and other provisions in that Schedule shall have effect in relation to the transferred land.

This Order provides that the Scheme shall be deemed to have come into force (in 2000) with the modification made by this Order. Section 413 of the Greater London Authority Act 1999 confers authority for the retrospective effect of this provision.

The Urban Regeneration Agency (London Development Agency) Transfer Scheme 2000 was made on 22nd June 2000 and was approved by the Secretary of State on 27th June 2000. A copy of the Scheme is available on the internet at http://www.gos.gov.uk/gol/Economy/Regional_ development/495101/. Alternatively, the Scheme may be inspected at, or a copy can be obtained by post from the Government Office for London, Floor 7, Riverwalk House, 157-161 Millbank, London SW1P 4RR.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
