The First Secretary of State, in exercise of the powers conferred upon him by paragraph 3 of Schedule 2 to the Planning and Compulsory Purchase Act 2004(1) hereby makes the following Order:
2004 c. 5. Schedule 2 of the 2004 Act does not apply in relation to Wales in relation to the decisions specified in article 2; see sections 55(2) and 118(3) of the 2004 Act and the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 (see article 2 and the entry in Schedule 1 for the 1990 Act).
