In exercise of the powers conferred on the Secretary of State by sections 344(2) and 569(1) and (2) of, and paragraph 14 of Schedule 28 to, the Education Act 1996(1), the Secretary of State for Education and Employment, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:
1.—(1) These Regulations may be cited as the Education (Grant-Maintained Special Schools) (Amendment) Regulations 1997 and shall come into force on 1st October 1997.
(2) In these Regulations “the principal Regulations” means the Education (Grant-Maintained Special Schools) Regulations 1994(2).
2. For regulation 41 of the principal Regulations there shall be substituted the following regulation—
41. Sections 23 and 29 of the Education Act 1997(3) shall apply in relation to a grant-maintained special school which is not established in a hospital as they apply in relation to a grant-maintained school.”.

These Regulations amend the Education (Grant-Maintained Special Schools) Regulations 1994 by substituting for regulation 41, which applied section 245 of the Education Act 1993 in relation to a grant-maintained special school not established in a hospital, a new regulation which applies sections 23 and 29 of the Education Act 1997 in relation to such a school.
