The Superannuation (Admission to the Principal Civil Service Pension Scheme) Order 1995

The Minister for the Civil Service, in exercise of the powers conferred by section 1(5) and section 1(8)(a) of the Superannuation Act 1972(1) and now vested in him(2), hereby makes the following Order:—

1.  This Order may be cited as the Superannuation (Admission to the Principal Civil Service Pension Scheme) Order 1995 and shall come into force on 6th June 1995.

2.  Employment by the Legal Services Ombudsman is hereby added to the employments listed in Schedule 1 to the Superannuation Act 1972 with effect from 1st January 1991.

3.  Employment by the Pensions Ombudsman is hereby added to the employments listed in Schedule 1 to the Superannuation Act 1972 with effect from 1st April 1991.

4.  Employment by the Local Government Commission for England is hereby added to the employments listed in Schedule 1 to the Superannuation Act 1972 with effect from 1st July 1992.

5.  The office of the Chairman of the Local Government Staff Commission (England) is hereby added to the offices listed in Schedule 1 to the Superannuation Act 1972 with effect from 13th May 1993.

6.  The office of the Pensions Ombudsman is hereby added to the offices listed in Schedule 1 to the Superannuation Act 1972 with effect from 1st September 1994.

7.  The office of the Data Protection Registrar is hereby added to the offices listed in Schedule 1 to the Superannuation Act 1972 with effect from 1st September 1994.

Explanatory Note

(This note is not part of the Order)

This Order adds—

(a)employment of staff of the Legal Services Ombudsman, and

(b)employment of staff of the Pensions Ombudsman and

(c)employment of staff of the Local Government Commission for England and

(d)the office of Chairman of the Local Government Staff Commission (England) and

(e)the office of the Pensions Ombudsman and

(f)the office of the Data Protection Registrar

to the employments and offices listed in Schedule 1 to the Superannuation Act 1972 so that the Principal Civil Service Pension Scheme and the Civil Service Additional Voluntary Contribution Scheme and the Civil Service Compensation Scheme made under section 1 of that Act may apply to them.

Provision for the appointment of the Legal Services Ombudsman and his staff was made by section 21 of the Courts and Legal Services Act 1990 (c. 41) and Schedule 3 thereto.

Provision for the appointment of the Data Protection Registrar was made by section 3 of the Data Protection Act 1984 (c. 35) and Schedule 2 thereto.

Provision for the establishment of the Local Government Commission for England was made by section 12 of the Local Government Act 1992 (c. 19) and Schedule 2 thereto.

Provision for the establishment of the Local Government Staff Commission (England) was made pursuant to section 23 of the Local Government Act 1992 (c. 19).

Provision for the appointment of the Pensions Ombudsman and his staff was made by section 145 of the Pension Schemes Act 1993 (c. 48).

Under the power conferred by section 1(8)(a) of the Superannuation Act 1972 the Order takes effect from—

(a)1st January 1991 in relation to the staff of the Legal Services Ombudsman;

(b)1st April 1991 in relation to employment by the Pensions Ombudsman;

(c)1st July 1992 in relation to the staff of the Local Government Commission for England;

(d)13th May 1993 in relation to the Chairman of the Local Government Staff Commission (England);

(e)1st September 1994 in relation to the Pensions Ombudsman;

(f)1st September 1994 in relation to the Data Protection Registrar.

By virtue of article 2(1)(c) of the Transfer of Functions (Minister for the Civil Service and Treasury) Order 1981 (S.I. 1981/1670) and article 3 of the Transfer of Functions (Treasury and Minister for the Civil Service) Order 1995 (S.I. 1995/269).
