The Secretary of State for Transport, in exercise of the powers conferred by sections 89(1)(f),(3) and (4)(b), 105(1), (3) and (4), 108(1)(1) and 192(1)(2) of the Road Traffic Act 1988(3), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, and in the case of regulations 4, 5 and 6 with the approval of the Treasury, hereby makes the following Regulations:

1.  These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) Regulations 1993 and shall come into force on 16th July 1993.

2.  The Motor Vehicles (Driving Licences) Regulations 1987(4) shall be amended in accordance with the following provisions of these Regulations.

3.  In regulation 5(2) (Applications for the grant of licences) for “one year” there shall be substituted “five years”.

4.  In regulation 19 (Fees in respect of tests)—

(a)in paragraph (3)(a)(ii) for “£44” there shall be substituted “£45”;

(b)in paragraph (3)(b)—

(i)in sub-paragraph (i) for “£23.50” there shall be substituted “£26”, and

(ii)in sub-paragraph (ii) for “£35” there shall be substituted “£36”;

(c)in paragraph (3A) for sub-paragraphs (a) and (b) there shall be substituted the following sub-paragraphs—

(a)£45 in the case of a test to drive a motor vehicle in category A or category P; and

(b)£36 in the case of any other test,; and

(d)in paragraph (5) for “£23.50” there shall be substituted “£26”.

5.  In regulation 19A—

(a)in paragraph (3)(b) for “£47” there shall be substituted “£48.50”; and

(b)in paragraph (4)—

(i)in sub-paragraph (a) for “£90” there shall be substituted “£92”, and

(ii)in sub-paragraph (b) for “£75” there shall be substituted “£77.50”.

6.  Regulations 4 and 5 of these Regulations shall not apply in the case of an application for an appointment for a test made before the coming into force of these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend regulations 5, 19 and 19A of the Motor Vehicles (Driving Licences) Regulations 1987 (“the 1987 Regulations”).

Regulation 5 of the 1987 Regulations is amended so that, for the purposes of section 89(1)(f) of the Road Traffic Act 1988 (“the 1988 Act”), the period of normal residence in Great Britain or, as the case may be, the United Kingdom during which the holder of an exchangeable licence is eligible for the grant of a licence under Part III of the 1988 Act is five years.Formerly the period was one year.

The amendments to regulations 19 and 19A of the 1987 Regulations increase the fees to be charged for some driving tests.From 16th July 1993 the fees for tests will be as follows—

(a)the fee for an ordinary test (as opposed to an extended driving test) taken before 4.30 pm on a weekday will be £34 in the case of a test of competence to drive a motorcycle or a moped (no change), and £26 in the case of any other test (an increase of £2.50): see regulation 4(b)(i);

(b)the fee for an ordinary test taken at or after 4.30 pm on a weekday will be £45 in the case of a test of competence to drive a motorcycle or a moped (an increase of £1) (see regulation 4(a)), and £36 in the case of any other test (an increase of £1): see regulation 4(b)(ii);

(c)the fee for an ordinary test taken on a Saturday will be £45 in the case of a test of competence to drive a motorcycle or a moped (an increase of £1), and £36 in the case of any other test (an increase of £1): see regulation 4(c);

(d)the fee for an extended driving test taken on a weekday will be £57 in the case of a test of competence to drive a motorcycle or a moped (no change), and £48.50 in the case of any other test (an increase of £1.50): see regulation 5(a);

(e)the fee for an extended driving test taken on a Saturday will be £92 in the case of a test of competence to drive a motorcycle or a moped (an increase of £2) (see regulation 5(b)(i)), and £77.50 in the case of any other test (an increase of £2.50): see regulation 5(b)(ii); and

(f)the fee for a test to drive a London cab will be £26 (an increase of £2.50): see regulation 4(d).

The increased fees to be introduced by these Regulations will not apply in the case of a person who applies for an appointment for a test before 16th July 1993: see regulation 6.

No fee is charged for a driving test taken in an invalid carriage.
