The Secretary of State for Transport, in exercise of the powers conferred upon him by section 11(1) and (2) of the Consumer Protection Act 1987(1) and of all other enabling powers, and after consultation with representative organisations, the Health and Safety Commission (as regards Great Britain) and such other persons as he considers appropriate in accordance with section 11(5) of that Act, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Motor Vehicles Tyres (Safety) (Amendment) Regulations 1992 and shall come into force on 1st January 1993.

2.—(1) The Motor Vehicles Tyres (Safety) Regulations 1984(2) shall be amended as follows.

(2) In regulation 2, before the definition of “maximum gross weight” there shall be inserted the following definition—

““designated approval mark” means a marking designated as an approval mark by regulation 5 of the Motor Vehicles (Designation of Approval Marks) Regulations 1979(3) and shown at item 33 in Schedule 4 to those Regulations;”.

(3) In regulation 3(1) after the words “unless the tyre” there shall be inserted “(a)” and at the end there shall be added—

“or

(b) is permanently and legibly marked with a designated approval mark.”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles Tyres (Safety) Regulations 1984.

The 1984 Regulations make it an offence for a person to supply certain tyres unless certain requirements are met.

The amendments make provision for tyres to be supplied if they do not meet the previous requirements but bear an approval mark pursuant to Council Directive 92/23/ EEC (OJ No. L129, 14.5.92, p.95).

The amendments broadly apply to car tyres which are not retreaded tyres.
