The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1.  This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (England) (No. 3) Order 1991 and shall come into force on 1st January 1992.

2.  The management of sports and leisure facilities by the council of the Royal Borough of Windsor and Maidenhead shall not be treated as a defined activity so long as it is undertaken at the Magnet Leisure Centre, Holmanleaze, Maidenhead during the occupation of those premises (whether as to the whole or any part) by contractors for the purposes of refurbishment of the premises in pursuance of an agreement made between that council and Isis Construction Limited on 8th May 1991.

3.  The management of sports and leisure facilities by a council mentioned in the first column of the following Table shall not be treated as a defined activity so long as it is undertaken at the place mentioned in the second column before the date mentioned in the third column.

Explanatory Note

(This note is not part of the Order)

Under Part I of the Local Government Act 1988 (Competition) work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.

This Order exempts from the requirements of Part I the management of sports and leisure facilities by the councils of the Royal Borough of Windsor and Maidenhead, the boroughs of Colchester and Tamworth and the district of South Somerset, so long as in each case specified conditions are met.
