The Annual Close Time (Rivers Irvine and Garnock Salmon Fishery District) Order 1990

The Secretary of State, on application to him by two proprietors of salmon fisheries in the Rivers Irvine and Garnock salmon fishery district, having carried out all necessary consultations and complied with all necessary procedures as required by paragraphs 3 and 4 of Schedule 1 to the Salmon Act 1986(1) as applied by section 6(6) of that Act (there being no objections or representations duly made with respect to the proposals in the application), in exercise of the powers conferred on him by section 6(3) of that Act and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Annual Close Time (Rivers Irvine and Garnock Salmon Fishery District) Order 1990 and shall come into force on 1st October 1990.

Period within the annual close time for salmon fishing by rod and line

2.  For the part of the Rivers Irvine and Garnock salmon fishery district specified in the Schedule to this Order, the period within the annual close time (the dates of which are by virtue of the provisions referred to in section 6(2)(b) of the Salmon Act 1986, 10th September to 24th February) when it is permitted to fish for and take salmon by rod and line is prescribed as the period from 10th September to 15th November, both dates inclusive.

Article 2

SCHEDULE

The part of the Rivers Irvine and Garnock salmon fishery district mentioned in article 2 of this Order comprises the catchment area and estuary of the River Irvine and the adjacent area of sea bounded on the north by a line drawn south west (true) from the north end of Irvine Bar (O.S. Grid Reference 22995 63780) and on the south by the southern boundary of the said district.

Explanatory Note

(This note is not part of the Order)

In relation to the annual close time of the Rivers Irvine and Garnock salmon fishery district (10th September to 24th February) this Order prescribes the period from 10th September to 15th November as the period during which fishing for salmon by rod and line is permitted in a specified part of the district. This part comprises the catchment area and estuary of the River Irvine and the adjacent area of sea between Irvine Bar in the north and the southern boundary of the salmon fishery district, in the south.

For the remaining part of the district the period during which such rod and line fishing is permitted in the annual close time continues to be from 10th September to 31st October.

By virtue of section 1(1) of the Salmon Act 1986 the area of the salmon fishery district extends seaward for a distance of 3 miles from mean low water springs of the coastal limits of the district and landward to include the catchment area of each river flowing directly or indirectly into the sea within those coastal limits.
