The Education Authority Bursaries (Scotland) Amendment Regulations 1989

The Secretary of State, in exercise of the powers conferred on him by section 49(3) of the Education (Scotland) Act 1980(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.  These Regulations may be cited as the Education Authority Bursaries (Scotland) Amendment Regulations 1989 and shall come into force on 1st August 1989.

2.  Regulation 2(6)(ii) of the Education Authority Bursaries (Scotland) Regulations 1988(2) is hereby amended by substituting, for the figure “3”, the figure “2”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education Authority Bursaries (Scotland) Regulations 1988 (“the principal Regulations”) so that a person is now classed as an “independent student” after being married for 2 years prior to the relevant date relating to the year of his course for which he is applying for a bursary. Previously a person was not so classed until he had been married for 3 years.

Whether or not a person is classed as an “independent student” is in certain circumstances a relevant factor in determining whether that person has been “ordinarily resident” in the British Islands or the European Community for an appropriate period (in terms of regulation 2(5) of the principal Regulations) and is thus eligible for a bursary.
