The Benzene in Toys (Safety) Regulations 1987

Whereas the Secretary of State has, in accordance with section 11(5) of the Consumer Protection Act 1987(1), consulted such organisations as appear to him to be representative of interests substantially affected by these Regulations and such other persons as he considers appropriate:

Now, therefore, the Secretary of State, in exercise of the powers conferred upon him by section 11 of the said Act, hereby makes the following Regulations:—

1.  These Regulations may be cited as the Benzene in Toys (Safety) Regulations 1987 and shall come into force on 31st December 1987.

2.  No person shall supply, offer to supply, agree to supply, expose for supply or possess for supply any toy (including any kit for making balloons) or part of a toy which contains benzene, or any substance which is intended for making balloons and contains benzene, where the concentration of benzene in the free state is in excess of 5 mg/kg of the mass of the toy or part of the toy or substance, as the case may be.

3.  The Novelties (Safety) Regulations 1980(2) are hereby amended in regulation 2 by omitting subparagraphs (1)and (2) and the proviso.

Explanatory Note

(This note is not part of the Regulations)

These Regulations implement Council Directive No. 82/806/EEC (O.J. No. L339, 1.12.82, p.55) by prohibiting the supply of toys (including balloon making kits) which contain benzene in excess of a specified concentration. They also prohibit the supply of substances for making balloons which contain benzene in excess of a specified concentration. They supersede regulation 2(a) and (b) of the Novelties (Safety) Regulations 1980, which prohibit the supply of any kit for making balloons where any substance from which the balloons are to be made contains benzene and the supply of any substance containing benzene which is intended for making balloons.
