Whereas by the Continental Shelf (Designation of Areas) Orders 1964 to 1982(1), certain areas outside the territorial waters of the United Kingdom are designated as areas within which the rights of the United Kingdom with respect to the sea bed and subsoil and their natural resources may be exercised:

And whereas parts of the areas so designated will fall within the seaward limits of the territorial sea as established by or under the Territorial Sea Act 1987(2);

Now, therefore Her Majesty, in exercise of the powers conferred upon Her by section 1(7) of the Continental Shelf Act 1964(3), section 3(3) of the Territorial Sea Act 1987 and all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.—(1) This Order may be cited as the Continental Shelf (Designated Areas) (Extended Territorial Sea) Order 1987 and shall come into force on 1st October 1987.

(2) This Order and the Orders recited in the preamble to this Order may be cited together as the Continental Shelf (Designation of Areas) Orders 1964 to 1987.

2.  Subject to Article 3 of this Order, the Continental Shelf (Designation of Areas) Orders 1964 to 1982 shall have effect without change, except that no part of the sea or sea bed and subsoil within the seaward limits of the territorial sea as extended by or under the Territorial Sea Act 1987 shall be regarded as forming part of a designated area.

3.  In respect of the matters referred to in section 2(3) and (4) of the Territorial Sea Act 1987 (which continue in effect certain legislation and instruments relating to coal and petroleum), the Continental Shelf (Designation of Areas) Orders 1964 to 1982 shall continue to have effect as they had effect immediately before the coming into force of the Territorial Sea Act 1987.

Explanatory Note

(This note is not part of the Order)

Parts of the areas designated under section 1(7) of the Continental Shelf Act 1964 as areas within which the rights exercisable by the United Kingdom outside territorial waters with respect to the sea bed and subsoil and their resources are exercisable will cease to have this status to the extent that they are brought within the seaward limits of the territorial sea as a consequence of its extension by or under the Territorial Sea Act 1987. This Order makes clear that the Orders designating such areas shall continue to have effect except that no part of the sea or sea bed or subsoil within the seaward limits of the territorial sea as extended by or under that Act shall be regarded as part of a designated area. However, section 2(3) and (4) of that Act preserves the existing operation of section 1(2) of the Continental Shelf Act 1964 in relation to coal and certain regulations and licences in relation to petroleum within the area which becomes part of the territorial sea by or under the Territorial Sea Act 1987 and this Order ensures that, in respect of these matters, the existing Orders defining the designated areas shall continue fully in effect.
