The Secretary of State, in exercise of the powers conferred upon him by sections 16(13), 30(4) and 120(1) of the Building Act 1984, and of all other powers enabling him in that behalf, hereby makes the following order:—
1. This order may be cited as the Building Act 1984 (Appointed Day and Repeal) Order 1985 and shall come into operation on 11th November 1985.
2. 11th November 1985 is appointed under section 16(13) of the Building Act 1984 as the day on which section 16(10) ceases to have effect as set out in section 16(13).
3. Section 30 of the Building Act 1984 is repealed.

Section 16(13) of the Building Act 1984 sets out an alternative version of section 16(10) which applies until such day as the Secretary of State appoints. Article 2 of the order appoints 11th November 1985. The effect is to terminate the jurisdiction of the magistrates courts to resolve disagreements with a local authority as to whether plans or proposed work comply with building regulations and to give a comparable jurisdiction to the Secretary of State.
Article 3 repeals section 30 of the Building Act 1984 which provides for persons carrying out work and local authorities jointly to refer disagreements about plans or work to the Secretary of State.
