  1. The regulations governing social care service providers and independent health care providers in Wales include requirements relating to vetting procedures for staff before they are permitted to start work. These are provided for by regulations under section 22 of the Care Standards Act 2000 and under section 27 of the Regulation and Inspection of Social Care (Wales) Act 2016. The Coronavirus Act allows the Welsh Ministers to issue a notice disapplying or varying the requirements to provide increased flexibility for providers to enable them to take steps to address workforce issues in a more agile way.
  2. Notices issued in this way must contain a statement by the Welsh Ministers, explaining why the step is appropriate and proportionate. Notices must not exceed one month though the Welsh Ministers may issue further notices as well as cancelling them.
