Section 32: Requirements in Part 2 of CRAGA

  1. Section 20 of the Constitutional Reform and Governance Act 2010 sets out certain conditions that must be met before treaties can be ratified. These are that: a Minister of the Crown has laid before Parliament a copy of the treaty, the treaty has been published, and the relevant period (21 sitting days) has passed without either House having resolved that the treaty should not be ratified.
  2. Section 32 disapplies section 20 of the Constitutional Reform and Governance Act 2010 in relation to the Withdrawal Agreement. This enables ratification of the Withdrawal Agreement to take place without the conditions of section 20 having been met, and avoids any additional delay that could be created by the 21 day process. The provision does not extend to future modifications of the Withdrawal Agreement agreed by the Joint Committee, to which section 20 may apply.
