European Union (Withdrawal Agreement) Act 2020

Section 17: Interpretation: Part 3

  1. This section provides definitions for terms used in Part 3 (citizens’ rights) of the Act.
  2. Subsection (1) sets out the definition for ‘residence scheme immigration rules’.
  3. Subsection (2) sets out the definition for ‘relevant entry clearance immigration rules’.
  4. Subsection (3) provides that references to having leave to enter or remain in the UK by virtue of the residence scheme immigration rules (which provide for the protected cohort) includes leave granted by virtue of those rules before the citizens’ rights provisions in the Act come into force.
  5. Subsection (4) states that a reference to a Chapter, Title or Part or other provision of the Withdrawal Agreement, the EEA EFTA Separation Agreement or the Swiss Citizens’ Rights Agreements in the citizens’ rights provisions of the Act includes a reference to any other provision in the Withdrawal Agreement, the EEA EFTA Separation Agreement, or the Swiss Citizens’ Rights Agreement that relates to that provision , as well as any provision of EU law which is applied by or referred to in that Chapter, Title, Part or other provision.
  6. Subsection (5) sets out the definitions of ‘entry clearance’, and ‘immigration rules’.
