Section 16(3).

SCHEDULE 1Consequential Amendments

1In each of the following provisions—

(a)section 11(2)(b) of the [1967 c. 13.] Parliamentary Commissioner Act 1967;

(b)section 11(2)(b) of the [1969 c. 10. (N.I.).] Parliamentary Commissioner Act (Northern Ireland) 1969;

(c)section 12(2)(b) of the [1969 c. 25. (N.I.).] Commissioner for Complaints Act (Northern Ireland) 1969;

(d)paragraph 16(4)(b)(ii) of Schedule 16 to the [1973 c. 38.] Social Security Act 1973;

(e)section 32(2)(b) of the [1974 c. 7.] Local Government Act 1974;

(f)section 30(2)(b) of the [1975 c. 30.] Local Government (Scotland) Act 1975;

(g)paragraph 16(4)(b)(ii) of Schedule 3 to the [S.I. 1975/1503 (N.I. 15).] Social Security Pensions (Northern Ireland) Order 1975;

(h)paragraph 16(b) of Schedule 13 to the [1977 c. 49.] National Health Service Act 1977;

(j)regulation 35(2)(a)(ii) of the [S.I. 1984/380] Occupational Pension Schemes (Contracting out) Regulations 1984;

(k)regulation 32(2)(a)(ii) of the [S.R. 1985 No. 259.] Occupational Pension Schemes (Contracting-out) Regulations (Northern Ireland) 1985,

for the words “the Official Secrets Acts 1911 to 1939” there shall be substituted the words “the Official Secrets Acts 1911 to 1989”.

2In section 22(6) of the [1978 c. 5.] Northern Ireland (Emergency Provisions) Act 1978 for the words “the Official Secrets Acts 1911 and 1920” there shall be substituted the words “the Official Secrets Acts 1911 to 1989”.

3In paragraph (b) of section 9(4) of the [1985 c. 56.] Interception of Communications Act 1985 the words “or 2” shall be omitted and after that paragraph there shall be inserted—

(bb)an offence under section 4 of the Official Secrets Act 1989 relating to any such information, document or article as is mentioned in subsection (3)(a) of that section;.

4Any provision in a public service pension scheme (within the meaning of the Social Security Act 1973 or the Social Security Pensions (Northern Ireland) Order 1975) which has effect in relation to conviction of an offence under the Official Secrets Acts 1911 to 1939 shall be construed as if the reference to such an offence included a reference to an offence under this Act.
