The Secretary of State(1) makes these Regulations, with the consent of the Treasury(2), in exercise of the powers conferred by section 14(1) of, and paragraph 1(1)(3) and (3) of Schedule 4 and paragraph 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 2018(4).
In accordance with paragraph 12(1) of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of these Regulations has been laid before Parliament and approved by resolution of each House of Parliament.
The Secretary of State is an appropriate authority for the purposes of paragraph 1(1) of Schedule 4 to the European Union (Withdrawal) Act 2018 (“the 2018 Act”); see paragraph 2(1) of Schedule 4 to the 2018 Act for the definition of “appropriate authority”.
Treasury consent is required pursuant to paragraph 3(1) of Schedule 4 to the 2018 Act.
The Secretary of State is the public authority on whom the relevant function was conferred by the Hazardous Substances and Packaging (Legislative Functions and Amendment) (EU Exit) Regulations 2020 (S.I. 2020/1647) under section 8(1) of the 2018 Act; see section 20(1) of the 2018 Act for the definition of “public authority”.
