The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018(1) and section 2(2) of the European Communities Act 1972(2).
The Secretary of State is designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to insolvency(3) and the protection of employees in the event of the insolvency of their employers(4).
In accordance with paragraph 1(1) of Schedule 7 to the European Union (Withdrawal) Act 2018 and paragraph 2(2) of Schedule 2 to the European Communities Act 1972 a draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament.
1972 c. 68. Section 2(2) was amended by section 27 of the Legislative and Regulatory Reform Act 2006 (c. 51) and by section 3 and the Schedule to `the European Union (Amendment) Act 2008 (c. 7).
The Secretary of State is designated by the European Communities (Designation) (No. 3) Order 2001 S.I. 2001/3495.
